The Bombay High Court in Goa on Monday overturned a notification from the Goa government reserving 41% postgraduate (PG) seats in the state quota for SC, ST and OBC candidates at Goa Medical College (GMC) and al Goa Dental College (GDC) from academic year 2021-22.

The May 4, 2020 state notification that reserved 12% for PG medical posts for STs, 2% for SCs and 27% for OBCs was in part based on the Goa Commission for SC / ST and Commission recommendations Goa for OBC, both of which the court overturned and overruled.
In their 95-page ruling, Judge MS Sonak and Judge MS Jawalkar stated: “Such a serious decision to reserve 41% of the state quota seats for PG courses at the GMC should have (been) preceded by the application of the mind to a host of relevant considerations referred to in a plethora of decisions by the Hon’ble Supreme Court on the matter, as well as the considerations reported by GMC’s Dean in his letter / notes … “
They were referring to the letter dated March 16, 2020 from GMC Dean Shivanand Bandekar to declare under secretary (health) that admission to PG courses in GMC had so far been unreserved for the SC, ST and OBC category … “The selection for PG places were assigned exclusively to the merit score (NEET-PG). This is because PG students deal with emergencies … to get a quality service, no reservations are kept for any category since the GMC is the only medical college in Goa … “he said in his letter.
Following the court’s decision, Congress attacked the BJP ruling for its failure to defend caste-based reservations in PG medicine courses in court. “This government is anti-bahujan samaj … This reflects the RSS ideology that has been against SC, ST, OBC,” said Goa Congress Chairman Girish Chodankar.
