The Minister of the Federal Capital Territory (FCT), Muhammad Bello, told the Abuja High Court yesterday that Zainab, daughter of the late President Umaru Musa Yar’Adua, has falsified several documents to claim ownership of a disputed plot of land. in Abuja. Bello further stated that there was nothing to prove that Zainab ever applied for the land in the FCT or made any payment officially or not to the Federal Capital Development Authority (FCDA) to allow her to own any land to Abuja. In a joint defense statement with Zainab’s lawsuit on ownership of land 506, Zone B 09, Kado District, Abuja, the minister and FCDA, who are 3rd and 4th defendants, in the lawsuit denied ever having assigned any plot of land to the applicant.
In the defense statement dated September 21, 2021 and filed on their behalf by their lawyer, Yakubu Abubakar, the minister and FCDA informed the court that Zainab claimed ownership of the land through a power of attorney that the donor, a certain Haliru Malami, later reneged. as an alleged seller. Zainab through his company, Marumza Estate Development Company Limited, sued Itban Global Resources Limited Haliru Malami, Bello and the FCDA claiming ownership of land 506, zone B 09, Kado district, Abuja, having allegedly bought the land by the FCDA through Itban Global Resources and Malami.
However, in their defense briefs, the 3rd and 4th defendants stated that before filing the case in court, Zainab allegedly provided conflicting accounts as to how the land had been acquired through a former FCT minister, as well as purchase by purchase from the 1st defendant. They claimed that the first defendant, who allegedly sold the land, issued a letter on March 4, 2021, denying they ever sold the land and ever issued a power of attorney to the plaintiff. They further argued that there was nothing in their Abuja Department of Land Administration and Geographic Information System records indicating that the plaintiff had paid any money, official or otherwise, in relation to the land, adding that their review of events revealed that the registration of the alleged power of attorney was irregular.
The 3rd and 4th defendants further alleged that upon discovering that the plaintiff was claiming the plot of land through irregular documents, they canceled and shelved an occupation certificate allegedly obtained by the FCDA. They then asked the court to dismiss the plaintiff’s lawsuit with the cost because she is not entitled to any claim in the original summons.
Judge Olukayode Adeniyi had allowed plaintiff to change her allegation and subsequently set 15 and 16 December 2021 for the final hearing on the matter. The judge on July 11, 2021 rejected a request from Zainab for an injunction against Bello and three others on the disputed land. Zainab, through his attorney, chief Sebastine Hon (SAN), filed a motion for notice begging the court to issue an injunction preventing the minister and other defendants in his case from taking further action on the disputed land. Judge O Adeniyi had felt that requesting an injunction at the litigation stage would not only delay the hearing of the matter, but will influence the substantive questions and counter arguments in the case.
